1. About these terms

These Terms & Conditions apply when you use fishgeek.co.uk or buy products through our online store. Fish Geek UK is operated by Devon Aquatics Ltd, company number 16751098, registered at 79 Hoker Road, Exeter, Devon, United Kingdom, EX2 5JA. In these terms, Devon Aquatics Ltd is referred to as “we”, “us” or “our”.

Some products are manufactured, printed or dispatched by carefully selected fulfilment partners acting on our behalf. Your purchase contract remains with Devon Aquatics Ltd and this arrangement does not reduce your statutory consumer rights.

You must be at least 18 years old, or have permission from a parent or guardian, to place an order.

2. Orders and the contract

Products displayed on the site are an invitation to place an order, not a binding offer. You make an offer when you complete checkout. We accept it when we send an order acceptance or production confirmation. An automated acknowledgement only confirms that we received your order.

We may decline or cancel an order before acceptance if a product is unavailable, payment is not authorised, delivery is not possible, the price or description contains an obvious error, or submitted content appears unlawful, offensive or to infringe another person’s rights. If payment has already been taken, it will be refunded.

Please check names, sizes, colours, artwork and delivery details before paying. Contact us promptly if something is wrong; made-to-order production may begin soon after acceptance and changes cannot always be made.

3. Products, prices and payment

We try to describe products accurately. Screen settings, print placement and natural material variations mean colours and finished products may differ slightly from images. Size information is a guide; please check it before ordering.

Prices are shown in the selected currency and include applicable UK VAT where required. Delivery and any other charges are shown before payment. Customers outside the UK are responsible for import duties, taxes and customs charges unless checkout expressly says otherwise.

Payment is handled by the payment provider displayed at checkout. An order is not accepted unless payment is authorised. We do not normally receive or store your full card number.

If you ask us to print uploaded artwork or personalisation, you confirm that you own it or have permission to use it. You grant us and our fulfilment partners a limited, non-exclusive licence to use it only as needed to produce, deliver and support your order.

4. Production and delivery

Many Fish Geek products are printed to order. Estimated production and delivery times are shown at checkout or in your order emails. They are estimates unless we expressly agree a fixed date. We will deliver without undue delay and normally within 30 days unless a different period is agreed.

We are responsible for the goods until they are delivered to the address you supplied, unless you arrange your own carrier. If an event outside our reasonable control causes delay, we will contact you and take reasonable steps to minimise it.

International orders may be opened or inspected by customs. Delays caused by customs are outside our control.

5. Cancellations, returns and refunds

Standard goods. For most standard products bought online, you may change your mind and tell us that you wish to cancel from the time you order until 14 days after the day you receive the goods. You then have a further 14 days to return them. Printing a standard Fish Geek design only after an order is placed does not by itself remove this right.

Personalised goods. The change-of-mind right does not apply to products made to your specifications or clearly personalised for you, such as an item printed with your name or uploaded design. This exception does not affect your rights if the product is faulty, misdescribed or not made as agreed.

Tell us clearly that you wish to cancel by using the contact details below. Unless the item is faulty or we say otherwise, you are responsible for the direct cost of returning it. You must take reasonable care of goods and may inspect them as you would in a shop; we may reduce a refund for loss in value caused by unnecessary handling.

For a valid change-of-mind cancellation, we refund the product price and the least expensive standard delivery option offered. We may wait until the goods are returned or you provide evidence of return. Refunds are made to the original payment method within 14 days of that point.

6. Faulty, damaged or incorrect goods

Products must be as described, of satisfactory quality and fit for purpose under the Consumer Rights Act 2015. If an item is faulty, damaged, misprinted or incorrect, contact us as soon as possible with the order number and, where helpful, photographs. We will offer the remedy required by law, which may include repair, replacement, price reduction or refund.

Nothing in these terms limits rights that cannot lawfully be excluded.

7. Website use and intellectual property

Fish Geek names, logos, artwork, photography, product designs and site content belong to us or our licensors. You may use the site for personal shopping and may not copy, scrape, republish, resell, reverse engineer, disrupt or misuse it without permission.

Do not upload unlawful, harmful, discriminatory, defamatory or infringing content, attempt unauthorised access, introduce malicious code, harvest personal data or interfere with another person’s use of the site.

Links to third-party sites are provided for convenience. Their services and privacy practices are controlled by them.

8. Our responsibility

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was made, or for business losses where you buy as a consumer. The site may occasionally be unavailable for maintenance, security or circumstances beyond our reasonable control.

9. Changes, law and disputes

We may update these terms for future use of the site or future orders. The version in force when your order is accepted applies to that order unless a change is required by law or you agree to it.

These terms are governed by the law of England and Wales. Consumers living elsewhere retain any mandatory protections of the country in which they live and may bring proceedings in any court available to them under applicable consumer law.

Please contact us first so we can try to resolve a complaint. You may also seek independent advice from Citizens Advice or your local consumer protection body.
